Wise Earth School of Ayurveda Ltd. (“WEA”) Terms of Use,
Privacy Policy, and Intellectual Property Rights

1. GENERAL CONDITIONS

Wise Earth School of Ayurveda, Ltd (“Wise Earth”) is a non-profit organization organized in the state of North Carolina, USA as a 501 (c) 3 organization and private school for the dissemination of Ayurveda, Yoga and Vedic Studies.

This online application and enrollment agreement is a legally binding instrument when completed and submitted online by the student and accepted by the school.

a. Acceptance of Terms.

By accessing WEA’s family of websites, including https://wiseearth.com and other WEA owned websites, (collectively, “the Site”), you agree to be bound by the terms and conditions described herein (“Terms of Use”) and any subsequent changes, as it may be updated from time to time. Except as specifically stated otherwise, these Terms of Use set forth the entire understanding relating to this subject matter.

b. Sever-ability.

If any provision of the Terms of Use is held to be invalid or unenforceable by any law, rule, order, or regulation of any government or by the final determination of any state or federal court, all remaining provisions hereof will remain in full force and effect.

c. Choice of Law.

By accessing the Site you agree that the statutes, laws, and regulations of the United States and the State of North Carolina, USA, without regard to conflicts of law principles, will apply to all matters relating to use of the Site, and you agree that any litigation shall be subject to the exclusive jurisdiction of the State or Federal Courts in Buncombe County, North Carolina.

d. Foreign Access.

The Site is controlled and operated in whole or in part by WEA in the United States. WEA makes no representation that the content in the Site is appropriate or available for use in other locations, and access to it from territories where the content may be illegal is prohibited.

e. Termination of Access.

WEA reserves the right in its sole discretion to refuse or terminate access to the Site by you at any time.

2. PRIVACY POLICY

a. Anonymous Data Collection.

WEA may gather from users of the Site, non-personal identifiable information (“Non-personal Information”) that web browsers, depending of their settings, may make available. That information may include, inter alia, the user’s IP address, operating system, browser type, and the pages a user visits.

WEA analyzes such Non-personal Information to help WEA better understand how the Site is being used and for business and marketing related purposes. From time to time, WEA may also share Non-personal information as collected and/or in the aggregate, with our business partners and advertisers, for marketing purposes and/or to improve acquisition channels.

b. Voluntary Data Submission.

From time to time, when users of the Site request further information about WEA and its program offerings, WEA may ask for personal identifiable information (“PII”), which may include contact information, email, gender, and/or age. PII may be used for internal marketing purposes, to contact users about the program for which they have expressed interest to personalize correspondence, and/or to distinguish adults from minors. From time to time, WEA may also use PII to offer Site users the opportunity to participate in contests, giveaways and other promotions. Any PII provided to WEA in connection with such activities will be treated in accordance with this privacy policy.

c. Use of “Cookies.”
1st Party Cookie

A “cookie” is a small text file placed on a user’s computer used to store information about the user. WEA may use cookies to track the pages that users to the Site visit during their online session, for marketing and advertising purposes, to help WEA improve users’ experiences, and/or to help WEA understand how the Site is being used.

Users who do not wish to have cookies placed on their computers should disable cookies through their web browser settings, with the understanding that disabling cookies may diminish a user’s experience on the Site and that certain features of the Site may not function properly without the aid of cookies. Cookies are not harmful and cannot introduce viruses or extract PII.

3rd Party Cookies

WEA may allow third party companies to set and access their own cookies. Such “third party cookies” are used to collect data about the Site’s traffic, for statistical analysis about the advertisements on the Site and to further customize and enhance a user’s experience on the Site. Third party cookies may also be used for traffic and conversion analysis and/or marketing purposes, which may include, inter alia, promoting display ads based upon users’ past behavior, showing WEA ads across the Internet and providing reporting on users’ interactions with our ad services. WEA does not control third party cookies and third party cookies are not governed by this Privacy Policy, but rather are governed by the privacy policy of the third party companies.
Users may choose to opt out of or disable third party cookies. Advertisers may allow users to opt out of ads by visiting their websites and customizing the user’s ad settings.
d. Disclosure of Information. If users opt-in to receive company marketing materials or other promotional items, WEA will provide such users’ first and last names and email information to third parties, so that those third parties may fulfill such requests. As explained below, users may opt out of receiving emails from WEA at any time. However, even after opting-out of WEA emails, a user may continue to receive marketing emails from third parties to whom WEA already has provided the user’s email information. Users are responsible for directly contacting such third parties to request removal from email lists.

WEA discloses PII when required to do so by law, or when WEA in good faith believes such action is necessary to protect the property or rights of WEA, third parties or the public at large.

e. Contacting You.

WEA may use your contact information to inform you of changes to the Site, or, if requested, to send you additional information about WEA. WEA has a no-spam policy and provides you with the ability to opt-out of our communications by selecting the unsubscribe link at the footer of all e-mails. WEA will not sell, rent or share your email address, and you may unsubscribe at any time through the unsubscribe link at the footer of all e-mail communication.

f. Assignment of Rights.

In the event of an assignment, sale, joint venture, or other transfer of some or all of WEA’s assets, you agree WEA may assign, sell, license or transfer any information that you have provided to us.

Honour Code:

All students participating in the class must agree to abide by the following code of conduct:

  • You will register for only one account.
  • Your answers to homework, quizzes and exams will be my own work (except for assignments that explicitly permit collaboration).
  • You will not make solutions to homework, quizzes or exams available to anyone else. This includes both solutions written by you, as well as any official solutions provided by WEA course instructors.
  • You will not engage in any other activities that will dishonestly improve my results or dishonestly improve/hurt the results of others.

You agree that all of the assignments and exams that I submit in fulfillment of the requirements of this course will be completely and entirely my own work, of my own creation, and written by my own hand, except where the instructor has designed a group project. I will not submit plagiarized work or any work that otherwise infringes on the copyright laws of the United States of America.

User Accounts: You agree that you will never divulge or share access or access information to your User Account with any third party for any reason. You also agree to that you will create, use, and access only one User Account, and that you will not access the Site using multiple User Accounts.

3. INTELLECTUAL PROPERTY

Any unauthorized use of any material -educational and otherwise-contained on this Site may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes. WEA monitors use of its copyrighted material on the Internet and will seek legal action against any infringing parties.

a. Copyrights

All content found on WEA’s site, except as noted otherwise, is exclusively and solely owned and copyrighted by WEA and/or its affiliates. No such content may be copied, reproduced, distributed, republished, downloaded, displayed, posted or transmitted in any form or by any means including, but not limited to, electronic, mechanical, photocopying, recording or otherwise, without WEA’s prior written consent. You may not “mirror” any content contained on this Site without express written consent from all educational and teaching materials of Wise Earth Ayurveda are unique and original sadhana forms of teachings developed by Maya Tiwari and Wise Earth School of Ayurveda, Ltd. All public presentation of Wise Earth Ayurveda Materials, Manuals, educational programs and their content, chants and creative sadhana prototypes are protected by US Copyright law and International treaties and public use of them is strictly prohibited without prior written consent from the Wise Earth School of Ayurveda, Ltd. No part of the school’s creative works or education can be used for making a film, or documentary, or writing a book, or for audios, or through online forums and or platforms, or social media, or any other form on electronic or non-electronic use, known and unknown. This includes utilizing any of the above in any form or by any means – for example, electronic or mechanical, including copying, recording, or by storage or retrieval system. Violators will be prosecuted to the fullest extent of the law whether in it is original form or language, or in paraphrased form – all such use, and also any excerpts from Maya Tiwari’s books, be they paraphrased, must be accompanied by the following specific “Wise Earth Ayurveda” credit lines with attribution back to its website, www.wiseearth.com, and the appropriate Wise Earth copyright identifications, where appropriate: (c)Wise Earth Ayurveda

The following trademarks and logos are the property of WEA (collectively, “WEA’s Marks”):

  • Name Trademarks: Wise Earth Ayurveda®, Wise Earth School of Ayurveda®, Inner Medicine Healing® Living Ahimsa®
  • Logo Trademarks: the WEA Elephant/Airavata Logo:® and the WES Elephant Logo®
  • Slogan Trademarks: “Nourish, Nurture and Heal” ™,”Food For One must be Food for All” ™; “Food, Breath & Sound “™; “Health Happiness and Harmony” ™; We are Wellness. Disease is an imposter”™; “Shaktify Healing”™; “Shaktification of Health” ™

This list of WEA’s Marks is current as of November 2016 and may be expanded in the future. The absence of a trademark or logo from this list does not constitute a waiver of WEA’s trademark or other intellectual property rights concerning that mark or logo.

When permitted to use WEA’s Marks in print or online, you must either include the appropriate ™ or ® symbol with each use, or use the appropriate trademark attribution notice. An appropriate example of notice would be: “Wise Earth Ayurveda® and Wise Earth School of Ayurveda® are registered trademarks of Wise Earth School,Ltd.

WEA’s Site may also display trademarks, logos, and/or service marks of other third parties. Users are not permitted to use any of these third party trademarks, logos and/or service marks without prior written consent from the respective rights holder.

c. Digital Millennium Copyright Act (DMCA) Notice

IIN respects the rights of other copyright holders. If you believe your copyright is being infringed, WEA will respond to notices of alleged infringement submitted in accordance with 17 USC §512(c)(3).

4. SECURITY

WEA takes reasonable precautions to protect information that has been provided to WEA by Site users. When users submit sensitive information via the Site, all information is protected both online and off-line. However, due to the nature of the Internet, WEA cannot completely ensure, guaranty, or warrant the security of any information transmitted to us or through our Site. Submitting information is done at your own risk. WEA has security measures in place to prevent the loss, misuse, and alteration of the information that WEA obtains from you, but WEA makes no guarantees about our ability to prevent any such loss, misuse, to you or to any third party arising out of any such loss, misuse, or alteration.

5. THIRD PARTY LINKS

The Site may contain links to third-party websites that are not controlled by WEA. If you choose to visit such websites, WEA is not responsible for the privacy practices or content of those websites, and it is your responsibility to review the terms and privacy policies of those websites to confirm that you understand and agree with their policies.

6. DISCLAIMER

a. No Warranties.

Information on the Site is provided “as is” without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

b. No Liability.

In no event will WEA be liable for damages of any kind relating to use of the Site, including without limitation any special, indirect, incidental, or consequential damages, even if WEA has been advised of the possibility of such damages.

c. Accuracy.

Although every effort is made to ensure the accuracy of published information on WEA’s web pages, the Site may inadvertently contain technical inaccuracies or typographical errors. This information may be changed or updated without notice. WEA assumes no responsibility for errors or omissions on the Site or in documents referenced by or linked to the Site.

7. MODIFICATIONS

WEA reserves the right to change the Site, these Terms of Use, or the policies and conditions that govern the use of the Site at any time. Please review this page periodically for any updates or changes. These Terms apply to all visits to the Site, both now and in the future. Your continued access of the Site shall be deemed your notification and acceptance of these changes.

STUDENT AGREEMENT:

I understand that gaining competence as a professional Ayurveda Practitioner in my chosen course of study will take a number of years of diligent study and practice.

At the successful completion of this one year online course I understand that I will receive a Wise Earth School Certificate with 500 hours (ACE ) recognized by and approved in NAMA’s Peripheral Course category. This certification grants me the title of Wise Earth Ayurveda Sadhana Lifestyle Consultant which means I may use this education to consult privately or in a clinic, share my knowledge with your community in the field of holistic healing; serve as a community consultant and even instruct wholesome nutrition education as a Wise Earth Ayurveda Sadhana Lifestyle Consultant.

Moreover I understand that the content of this course does not replace or include medical diagnosis and recommendation.
